VOICE-OVER: "Roos makes and sells toys to consumers. She is responsible for the safety of the products. She make sure they meet the EU requirements, so that children can play with them safely. Roos now wants to sell two new products: modeling clay for kids and a toy robot. She makes the modeling clay herself. That makes her the manufacturer of this product. So she has to make a technical file." Roos creates a folder on a computer VOICE-OVER: "For example, with all the information about the ingredients and how the clay is made." The step by step creation process is written down. VOICE-OVER: "Roos imports de toy robot from a country outside the EU. Because Roos puts her own logo on the product she is unsure about what role and responsibility she has according to the law. So she checks on business.gov.nl what her roll is. There she discoveres that she is a manufacturer rather than an importeur, because she is put her logo on the product. So for the toy robot Roos also has to keep a technical file and the robot must meet the requirements for toys and electrical appliances. If Roos her products do not meet the safety requirements she could suffer unpleasant consequences. She would have to take the product of the market and disclose that her product does not meet safety requirements. She must also report the unsafe product with the Netherlands Food and Consumer Product Safety Authority, NVWA. And indicate what measures she has taken to limit any risks. She is then left with unsellable stocks. Have customers already bought and owned the unsafe product? Then Roos must offer to repair the products or refund the money or offer a replacement product. If she is held liable by customers, she has to compensate any damage caused by her products. She could also get a fine from the supervising authority. Roos could lose so much money as a result that she has to end her business. Roos wants to be sure that her products meet all product requirements so she hires a consultancy firm to help her.
